  • Marketing attribution data, including UTM parameters, click identifiers, and session information captured by tools such as the HubSpot UTM Stitcher.
  • Account and transaction data required to operate products you sign up for, such as merchant settlement details in Southpay or appointment and messaging data in Elenia.

Attribution is core to what we build. Where enabled, the HubSpot UTM Stitcher reads and stitches UTM parameters and session identifiers so that conversions can be tied back to their original source. You can control cookies through your browser settings, though some features may not work without them.

We do not sell your personal information. We share it only in the following circumstances:

  • With service providers and infrastructure partners who process data on our behalf under appropriate confidentiality and security terms.
  • With platforms you have connected, such as HubSpot, payment networks, or messaging providers, to deliver the service you requested.

Product specific notes

Southpay processes payment and settlement data needed to accept cryptocurrency and settle funds to merchants. Transaction details are retained to meet financial and anti-fraud obligations.

Elenia processes the messages, voice notes, and appointment data required to operate an AI receptionist on WhatsApp. This data is used to respond to customers and manage bookings on behalf of the businesses that use it.

The HubSpot UTM Stitcher processes attribution and session data so that marketing sources can be matched to records inside HubSpot.

Acceptance of these terms

These Terms of Service govern your access to and use of the ALC Media website and products. By using our services, you agree to these terms. If you do not agree, please do not use our services.

Use of our services

You may use our services only in compliance with these terms and all applicable laws. You agree not to misuse the services, interfere with their operation, attempt to access them using a method other than the interfaces we provide, or use them to violate the rights of others.

Accounts and eligibility

Some products require an account. You are responsible for the activity that happens under your account and for keeping your credentials secure. You must provide accurate information and be legally able to enter into these terms in your jurisdiction.

Payments and settlement

Paid services, including Southpay, are billed according to the pricing presented to you at signup. Cryptocurrency transactions are irreversible once confirmed on their network. You are responsible for any taxes associated with your use of the services. Fees are non-refundable except where required by law or expressly stated otherwise.

Intellectual property

The services, including all software, designs, text, and branding, are owned by ALC Media or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the services as intended. You retain ownership of the content and data you provide to us.

Third party services

Our products connect to third party platforms such as HubSpot, Shopify, WooCommerce, WhatsApp, and payment networks. Your use of those platforms is governed by their own terms and policies, and we are not responsible for their practices.

Disclaimers

The services are provided on an as is and as available basis without warranties of any kind, whether express or implied. We do not warrant that the services will be uninterrupted, error free, or that any specific revenue outcome will be achieved. Any performance figures shown on our site are illustrative and not a guarantee of results.

Limitation of liability

To the fullest extent permitted by law, ALC Media will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising from your use of the services. Our total liability for any claim will not exceed the amount you paid us for the relevant service in the twelve months before the claim.

We may update these terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you. Your continued use of the services after changes take effect means you accept the revised terms.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Any disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.
